This case was filed in the U.S. District Court for the Eastern District of Michigan by current and former students of the University of Michigan, and one former registered student organization, SAFE. They alleged that, during the 2023-2024 academic year, University officials punished them because of their vocal advocacy for the human rights of Palestinians and their calls for the University to divest from Israel, and they sought class action status.  The case was assigned to District Judge Laurie Michelson.  On March 20, 2026, the court dismissed some of the complaints for failure to state a claim (individual due process claims, and individual equal protection claims) but allowed others to go forward (individual First Amendment claims, SAFE's due process and equal protection claims).

TEXT-ONLY ORDER: In response to Plaintiff's original complaint, Defendant filed a motion to dismiss. (ECF No. 27.) Pursuant to Federal Rule of Civil Procedure 15(a)(1)(B), which allows a party to amend its pleading "once as a matter of course within... 21 days after service of a responsive pleading or 21 days after service of a motion under Rule 12(b)," "if the pleading is one to which a responsive pleading is required," Plaintiff filed an amended complaint (ECF No. 30). The Court thus DENIES AS MOOT Defendant's motion to dismiss (ECF No. 27), which was made in response to the first complaint. See Myslivecek v. FCA US LLC, No. 23-12980, 2024 U.S. Dist. LEXIS 26685, at *2 (E.D. Mich. Feb. 15, 2024) ("It follows that motions directed at the superseded pleading, such as Defendant's motion here, generally are to be denied as moot." (citations omitted)); Parry v.
