The plaintiff, who was enrolled at a college in California's Inland Empire and in full compliance with F-1 student visa requirements, received notice on or about April 1, 2025, that their student visa was revoked and their Student and Exchange Visitor Information Systems (SEVIS) record was terminated by U.S. Immigration and Customs Enforcement (ICE). The termination cited deportability provisions for failure to maintain status and foreign policy grounds, despite the plaintiff's only criminal history being a minor misdemeanor non-alcohol related driving conviction. The plaintiff alleges that ICE lacks authority to terminate SEVIS records based solely on visa revocation and that this policy disproportionately targets students from African, Arab, Middle Eastern, Muslim, and Asian backgrounds. The complaint seeks declaratory and injunctive relief under the Administrative Procedure Act and Fifth Amendment, arguing the termination violated procedural due process and exceeded statutory authority.
