In March 2026, the Commonwealth of Massachusetts, California, New York, and 19 other states, along with the District of Columbia, the U.S. Virgin Islands, Governor Josh Shapiro of Pennsylvania, and numerous major cities including New York City, Los Angeles, Chicago, and Boston, filed a petition for review with the U.S. Court of Appeals for the District of Columbia Circuit. The petitioners challenged the Environmental Protection Agency's (EPA) final action titled "Rescission of the Greenhouse Gas Endangerment Finding and Motor Vehicle Greenhouse Gas Emission Standards Under the Clean Air Act," which was published in the Federal Register in February 2026. This EPA action rescinded the agency's 2009 Endangerment Finding that determined greenhouse gases endanger public health and welfare, and it repealed all associated greenhouse gas emission standards for light-duty, medium-duty, and heavy-duty motor vehicles and engines manufactured for model years 2021 to 2026 and beyond. The petitioners, represented against EPA Administrator Lee Zeldin, sought judicial review of this agency action under the Clean Air Act's appellate jurisdiction provisions.
