Case Summary
The EEOC's Milwaukee office sued Park Nicollet Health Services, a Minnesota health care provider operating the Park Nicollet Clinic, on April 22, 2004 in the U.S. District Court for the district of Minnesota. The EEOC's complaint is not available, however the intervenor's complaint (intervened in July 2004) states that the cause of action was the clinic's violation of the Americans with Disabilities Act when it failed to reasonably accommodate the intervenor's disability (viral encephalitis) so that she could practice medicine and ultimately discharged the intervenor for her disability.
The parties entered into a consent decree on May 18, 2005, which stipulated that the clinic would be enjoined from discriminating based on disability in the future, would train management and human resources employees for compliance with the ADA, post a notice of compliance with the ADA, disseminate a policy statement of compliance with the ADA to all employees, and report to the EEOC semiannually for three years about any employee terminated because of a disability. The three-year decree further stated that the clinic would provide the intervenor with a positive letter of reference and pay $155,000 in damages, attorney's fees, and costs to the intervenor. A few days later, the parties stipulated to, and the court ordered, a two-month extension of the decree. As there is no further activity on the docket sheet, presumably the case closed on July 18, 2008 when the consent decree expired.
