In September 2001, the EEOC's Seattle District Office brought this suit against Sinclair Oil Corporation, d/b/a Sun Valley Company, in the U.S. District Court for the District of Idaho. The complaint alleged that the defendant violated Title VII of the Civil Rights Act of 1964 by failing to rehire the charging party, a female employee, because she had participated in an internal sexual harassment investigation. In December 2001, the charging party intervened in the suit. After a failed motion by the defendants for partial judgment on the pleadings in April 2002, the parties settled in July 2002 through a consent decree.

Under the two-year decree, which contained non-discrimination and non-retaliation provisions, the defendant agreed to: maintain its EEO policy and internal Title VII compliance procedures, post an EEOC-provided Title VII compliance notice, provide the charging party with a neutral reference, expunge the charging party's personnel file of all references to discrimination, provide EEOC-approved managerial Title VII training, report to the EEOC at specified intervals, and pay $30,000 to the charging party.
