The St. Louis District Office of the EEOC brought this action in the U.S District Court for the District of Kansas, against GMRI, Inc. d/b/a Red Lobster, a national chain restaurant. The complaint, filed in September 2003, alleged sex discrimination in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the charging party was sexually harassed by a coworker and as a result, the conditions of her employment were made so intolerable that she was forc…

The St. Louis District Office of the EEOC brought this action in the U.S District Court for the District of Kansas, against GMRI, Inc. d/b/a Red Lobster, a national chain restaurant. The complaint, filed in September 2003, alleged sex discrimination in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the charging party was sexually harassed by a coworker and as a result, the conditions of her employment were made so intolerable that she was forced to resign.

The charging party intervened in April 2004 and in October 2004 the parties settled and a consent decree was entered. The decree, which was valid for 2 years, required that the Defendant pay a total of $60,000 ($17,850 to the charging party for compensatory damages, $1,000 to the charging party for back pay and $41,149.20 to the charging party's lawyer for fees and costs). The decree also required the Defendant to provide mandatory EEO training for its managerial employees, post a notice of non-discrimination at its facility, and distribute said notice to every managerial employee for signature. Defendant also had to regularly report (every 6 months) to the EEOC about any internal complaints of sexual harassment.
