In August 2006, the Baltimore (along with the Philadelphia) office of the EEOC brought this Title VII and ADA suit against Safeguard Maintenance Corp. in the U.S. District of Maryland. The complaint alleged that the defendant discriminated against the claimants by subjecting them to sexual harassment because of their sex and taking tangible employment action (including discharge/constructive discharge) against the claimants. The defendant also made inquiries, prior to an offer of employment, as to whether the applicant had a disability or the severity of a disability. The claimants intervened in the suit in December 2006 adding claims under the Fair Labor Standards Act of 1938, the Maryland Wage and Payment Act, and the MD Code Ann., Labor & Empl. sec. 3-420 through 3-505. The court dismissed the case because of a settlement in January 2007. The court entered a consent decree in February 2007 and the claimants voluntarily dismissed their complaints. The three year consent decree required the defendant to refrain from discrimination and retaliation, pay the claimants $60,000, post notice, revise its sexual harassment policy, provide two hours of mandatory training for all managerial and supervisory employees, give the EEOC the right to monitor its compliance with the decree. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2010.
