In September 1999, the Richmond office of the EEOC brought this suit against USA Waste Management, Inc., whose legal name was "Waste Management of Virginia, Inc.", in the U.S. District Court for the Eastern District of Virginia. The complaint is unavailable, and the exact allegations brought by the EEOC are unknown. In October 1999, the defendant filed a motion to dismiss, which was denied, and the defendant answered the complaint in November.

In January 2000, Waste Management filed a motion for summary judgment, which was granted the next month. The EEOC filed a notice of appeal in April 2000, but it moved for voluntary dismissal of its appeal in May 2000 in the U.S. Court of Appeals for the Fourth Circuit.
