A private plaintiff brought this case against New Prime, Inc., a trucking company, in the U.S. District Court for the Western District of Missouri in March 2001. A private plaintiff brought this case against New Prime, Inc., a trucking company, in the U.S. District Court for the Western District of Missouri in March 2001. The case was consolidated with a suit brought by the EEOC in August 2001. Two other complainants intervened in this case. The defendant filed several motions to dismiss, which were denied. The defendant also filed several partial motions for judgment on the pleadings, one of which was granted. The defendant also filed several motions for summary judgment, one of which was granted. The case went to a jury trial in September 2003. The jury found for one plaintiff on her Title VII claims and for the defendant on the other plaintiff's claims. The EEOC, an intervenor, and the defendant appealed the district court's judgment, but the appeal was dismissed in July 2004 after the parties reached a settlement. The court entered injunctive relief in December 2003. This included providing a neutral reference for and expunging the employment record of the complainant; conducting sexual harassment training to all employees; issuing yearly reports to the EEOC stating that training was conducted; and posting a notice of employment rights.
