In May 2002, the Phoenix District Office of the EEOC brought this lawsuit against Phoenix Suns Limited Partnership, a basketball team and Sports Magic Team, a sports entertainment group, in the U.S. District Court for the District of Arizona. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, it appears from the EEOC press releases that the complaint alleged the defendants discriminated against the three charging parties, females, in violation of Title VII of the Civil Rights Act of 1964 by failing to hire women during the 1998-9 and following seasons to perform certain stunts during sporting events. Following extensive discovery, the parties settled the lawsuit in October 2003 through consent decrees.

We do not have copies of the decrees; therefore, the exact remedies involved are unknown. However, it appears from the docket and press releases that the defendants signed a three-year consent decree, containing anti-discrimination and retaliation clauses, requiring the defendants to: maintain records concerning implementation of the consent decree, issue an apology and references for the charging parties, utilize objective hiring criteria, affirmatively recruit women, post notice of employee rights, provide annual training to all employees with supervisory responsibilities for hiring, recruiting or preparing recruitment advertisement, and pay $104,500 to be distributed among three charging parties.

CONSENT JUDGMENT by Judge James A. Teilborg : granting motion (Joint) for Entry of Consent Decree by pla EEOC, dft Phoenix Suns Ltd Prt [101-1] dismissing dft Phoenix Suns Ltd Prt ; ORDERE ADJDUGED AND DECREED ... this consent decree resolves all claims by the Commission, including all claims asserted by the Commission on behalf of Kathryn Tomlinson and class members Makia White and Nathasha Jenkins, against the Phoenix Suns in this lawsuit, including without limitation, claims for back pay, compensatory and punitive damages, injunctive relief, costs and attorneys' fees; this consent decree conforms with the Federal Rules of Civil Procedure and Title VII....; this decree applies to the Phoenix Suns, its officers, agents, employees, successors ans assigns; the decree also requires that Phoenix Suns take reasonable steps to ensure that any 3rd party involved in the recruitment, hiring and advertising of the Zoo Crew or any similar successor entertainment team who provides services pursuant to the decree complies with the decree with respect to any services provided; for the purposes of this decree, "Game Entertainment" means all on-court, non-sports entertainment provided by the Phoenix Suns during Phoenix Suns home games, including the Zoo Crew and Phoenix Suns Dancers, but excluding occasional performers (such as anthem singers and halftime acts) and television and radio broadcast talent; INJUNCTIVE RELIEF for the duration of the decree, the Phoenix Suns will not (a) discriminate against any employee based on sex, or (b) retaliate against any employee because he or she (i) opposed discriminatory practices made unlawful by Title VII, (ii) filed a charge or is assisting or participating in the filing of a charge of discrimination, or (iii) assisted or participated in an investigation or proceeding under Title VII; for the duration of the decree, the Suns agree to conduct recruitment, hiring and advertisement practices for Game Entertainment positions in a non-discriminatory manner and to state the same in all recruitment and advertisement materials; for the duration of the decree, the Suns shall affirmatively recruit women for the Zoo Crew or successor entertainment team; MONETARY RELIEF the Phoenix Suns will pay $82,500 to Ms Tomlinson and the other class members in 2 payments; this payment represents payment of compensatory damages; CORRECTIVE POLICIES AND PRACTICES the Phoenix Suns will post, for the duration of the decree, in a prominent place frequented by its employees at all its facilities, the notice attached as exhibit B; within 3 mos...and on an annual basis, the Suns will provide Title VII training for all employees with supervisory responsibilites for hiring, recruiting or preparing recruitment advertisement; RECORD KEEPING AND REPORTING that Phoenix Suns shall maintain all records concerning its implementation of this consent decree for the entire term of this consent decree; each party shall bear its own costs in conjunction with the maintenance of records, preparation of any report, access or copy of records or interview of employees required by the consent decree; MISCELLANEOUS PROVISIONS within 30 days of the entry of this decree, the Phoenix Suns' Director of Human Resources shall enter a letter of apology to Kathryn Tomlinson; within 30 days of the entry of this decree, the Phoenix Suns agree to provide a reference letter attached as exhibit C to Kathryn Tomlinson; the Court shall retain jurisdiction of this action for a period of 3 yrs after entry of the consent decree (cc: all counsel/jgm drawer) (LAD) (Entered: 10/16/2003)
