The EEOC filed this suit on March 27, 2003 in the U.S. District Court for the Middle District of Florida (Tampa). Two complainants intervened in the suit. The EEOC alleged that defendant Checkers Drive-In Restaurants, Inc. violated Title VII by subjecting the two female complainants to sexual harassment resulting in a hostile work environment. The intervenors further alleged violation of a Florida anti-discrimination statute. The defendant filed three motions to dismiss and one motion for summary judgment, all unsuccessful. The motion for summary judgment was denied after the parties stipulated to dismissal of the case. A settlement conference was held February 23, 2005. A consent decree was filed March 9, 2005 and the decree was entered into the record March 10, 2005. In the consent decree the defendant agreed to post notice, report to the EEOC regarding complaints, and provide annual training sessions to employees. The consent decree recognized monetary payment to complainants in an undisclosed amount. The decree was to last for three years. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2008.
