In March 1998, the Dallas District Office of the EEOC brought this suit against AMR Eagle, Inc., American Airlines, Inc., and related businesses in the U.S. District Court for the Northern District of Texas. The EEOC alleged that the defendants violated the Americans with Disabilities Act ("ADA") by refusing to hire flight attendant applicants who were disabled but could still perform the essential job functions required for the position. After numerous discovery disputes, the charging party intervened in the suit in September 1999. After several scheduling orders and great amount of discovery disputes, the EEOC and the defendants settled in July 2000 through a consent decree. The charging party and the defendants settled their remaining claims in May 2001, voluntarily dismissing the case.

The two-year consent decree between the EEOC and the defendants prohibited the defendants from discriminating or retaliating and required them to: discontinue the use of their former hiring guidelines, give applicants an opportunity to appeal any hiring decisions made by their medical department, provide ADA training for their medical personnel, post an ADA notice, expunge the interested parties' application files from all references to the charges of discrimination, report to the EEOC at specified intervals, and pay $500,000.
