Case Summary

In May 2002, the Saint Louis District Office and Kansas City Area Office of the EEOC filed this lawsuit against Consolidated Freightways Corporation of Delaware in the U.S. District Court for the Western District of Missouri alleging discrimination on the basis of race, African-American, in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged the defendant subjected the twelve complaining dockworkers to a racially hostile work environment and retaliated against them for complaining about the hostile work environment. Following some discovery and the declaration of bankruptcy by the defendant in September 2002, the parties settled the lawsuit in July 2005 through a consent decree. The consent decree gave the twelve complaining parties and their attorneys $2.75 million dollars in unsecured claims against the defendant's company and required the defendant to report any payments made to the EEOC.
