The Miami District Office of the EEOC brought this suit against Midnight Gambler Casino Cruises in September of 2000, in the U.S. District Court for the Southern District of Florida. The suit alleged violation of Title VII by discrimination against a black employee. The case involved a motion for a protective order and then little action to follow. There was a motion for summary judgment by both sides; however neither was resolved until the consent decree mentioned in paragraph 25 that all motions not resolved are denied as moot. The court ordered mediation and then ultimately the case was settled. There was a four month gap between the order dismissing the cause upon settlement and the actual consent decree being filed. The consent decree was ultimately filed on August 26, 2002.

The consent decree contained both injunctive and monetary relief. The injunctive relief required the defendant to not discriminate or retaliate against anybody in violation of Title VII. In addition the injunction required the defendant to develop an anti-discrimination policy and to train their managers once a year for four years. There would be notice of the suit posted in the facility and each employee would be handed the anti-discrimination policy. The monetary relief totaled $25,000 and was to be paid in three payments with the first being $5,000 and the subsequent payments being $10,000.
