Case Summary

The Cleveland District Office of the EEOC brought this action in the U.S. District Court for the Southern District of Ohio, against Watkins Motor Lines, Inc. The complaint was filed in October 2002, and though we do not have the complaint, the Appellate opinion indicates that the EEOC alleged a violation of the Americans with Disabilities Act when Watkins fired the complainant due to his morbid obesity. In February 2004 Defendant moved for summary judgment. The motion was granted in December 2004 and the case was dismissed. The EEOC appealed in February 2005, but the judgment was affirmed by the United States Court of Appeals for the Sixth Circuit. This opinion can be found at 463 F.3d 436 (6th Circuit 2006).
