Case Summary

The EEOC's Louisville and Indianapolis offices filed this suit on November 24, 2004 in the Southern District of Illinois (Benton). The suit alleged violation of Title VII for discriminating against employees based on sex (female) and pregnancy. A trial date was set soon after the complaint was filed. After the defendant's motion to dismiss was denied, the defendant filed a motion for entry of consent decree and dismissal of suit. The consent decree was entered on November 3, 2005.

In the consent decree, the defendant agreed to pay a total of $35,000 to the two complainants; one $22,500, the other $12,500. Defendant also agreed to provide training to its employees, report to the EEOC regarding complaints received, and allow the EEOC access to monitor its compliance. The settlement term was 2 years. The docket sheet does not show any further enforcement; the case was presumably closed in 2007.
