In December 1999, the Memphis and Nashville offices of the EEOC brought this Title VII suit against The Guardian in the U.S. District Court for the Middle District of Tennessee. The complaint alleged that the defendant insurance company discriminated against the claimant by discharging her when she signed a client with an outside insurance company, but not discharging four similarly situated male employees who signed clients with an outside insurance company. In December 1999, the Memphis and Nashville offices of the EEOC brought this Title VII suit against The Guardian in the U.S. District Court for the Middle District of Tennessee. The complaint alleged that the defendant insurance company discriminated against the claimant by discharging her when she signed a client with an outside insurance company, but not discharging four similarly situated male employees who signed clients with an outside insurance company. The defendant filed a motion to dismiss and in the alternative, a motion for summary judgment in April 2000, and the court denied both motions in February 2001. The defendant filed a second motion for summary judgment in April 2002, and the court denied the motion in October 2002. The case settled by entry of a consent decree in November 2002. The court ordered the defendant to pay $103,000 to the claimant, and provide the claimant with a neutral reference. No other information was made available pertaining to the nature of the suit or the consent decree.
