The case was consolidated with a private suit brought by private plaintiffs (Jefferson v. Ingersoll Int'l Inc, case #3:99-cv-50362). In July 2001 a consent decree was entered, but the plaintiffs struggled to enforce it, until finally the defendants filed for bankruptcy in June 2003.
