In September 2005, the Tampa Area Office and Miami District Office of the EEOC and Florida chapter of the ACLU filed this lawsuit against Diversified Behavioral Health Solutions, Inc., formerly known as Central Florida Youth Services, Inc., in the U.S. District Court for the Middle District of Florida alleging discrimination on the basis of sex, female, in violation of Title VII of the Civil Rights Act of 1964. In September 2005, the Tampa Area Office and Miami District Office of the EEOC and Florida chapter of the ACLU filed this lawsuit against Diversified Behavioral Health Solutions, Inc., formerly known as Central Florida Youth Services, Inc., in the U.S. District Court for the Middle District of Florida alleging discrimination on the basis of sex, female, in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendants created a sexually hostile work environment through verbal statements made to women employed at the defendant's worksite in Bowling Green, Florida. The case was assigned to Judge Elizabeth A. Kovachevich.

In January 2006, two of the women employed by the defendant intervened in the lawsuit, and were added as intervening plaintiffs in an amended complaint. In June 2006, the intervening plaintiffs motioned to consolidate their own lawsuits against defendant in the interest of avoiding multiple unnecessary lawsuits. In July 2006, the court denied this motion, stating that while there may be some common questions of law, there are still factual differences because of each of the claims. The court held that each plaintiff would still have to prove each of their individual claims.

In January 2007, the EEOC motioned for default judgment against the defendant. This motion was granted, and following discovery the Court entered a default judgment against the defendant in October 2007. The defendant was required to pay $158,997.59 to the complaining parties, and $16,255 in attorneys' fees.
