On September 30, 2002, the Miami office of the Equal Employment Opportunity Commission filed a lawsuit under the Americans with Disabilities Act against Cedars Healthcare Group, Ltd. in the U.S. District Court for the Southern District of Florida. On March 6, 2003, the case was referred to mediation, but the mediation did not result in a settlement. On October 1, 2003, the defendants filed a motion for sanctions against the EEOC, claiming that the EEOC had engaged in constant dilatory tactics, repeatedly failing to hand over information in discovery. On October 9, 2003, the defendant filed for summary judgment.

On December 5, 2003, the district court granted the defendants' motion for sanctions, finding that the EEOC had engaged in inappropriate dilatory tactics. On March 8, 2004, the district court ordered the EEOC to pay the defendants $7,945.50 in legal fees and $1072.04 in costs.

On September 27, 2004, the district court granted summary judgment to the defendants and closed the case. The EEOC appealed the summary judgment order, and on February 13, 2006, the U.S. Court of Appeals for the Eleventh Circuit dismissed the appeal.
