This case was filed on Dec. 18, 2000 against Emery Worldwide Airlines, Inc. and CNF, Inc. in the U.S. District Court for the District of New Jersey. The plaintiffs, seven black employees of Emery Worldwide, alleged that Emery Worldwide had violated Title VII of the 1964 Civil Rights Act. This case was filed on Dec. 18, 2000 against Emery Worldwide Airlines, Inc. and CNF, Inc. in the U.S. District Court for the District of New Jersey. The plaintiffs, seven black employees of Emery Worldwide, alleged that Emery Worldwide had violated Title VII of the 1964 Civil Rights Act. Specifically, the plaintiffs claimed that managers at Emery Worldwide's Mail Processing Center in Kearny, New Jersey used racial slurs, vandalized black employees' property, and displayed hangman's nooses. The employees further alleged that they were retaliated against when they complained about the harassment.

The only documents publicly available regarding this case is the docket and a press release from the EEOC, so some case specifics are missing. On February 21, 2001, the defendants filed a motion for summary judgment. In August that same year, this case was consolidated for discovery with an Equal Employment Opportunity Commission suit against the same defendant EEOC v. Emery Worldwide Airlines, Inc.. CNF filed a motion to dismiss for lack of personal jurisdiction on April 9, 2002, which Judge Joseph A. Greenaway, Jr. granted on May 7. CNF's motion for summary judgment was concurrently denied because it was mooted by CNF's dismissal from the case. Emery Worldwide Airlines' motion to dismiss was never resolved because the parties settled out of court in September 2002, voluntarily dismissing the case.
